Wasiyyat for a murtad
Q: Can a person make a wasiyyat for a murtad and if he makes one does it have to be fulfilled?
A: Irtidaad is a major criminal offence. In regard to a murtad, Shariah commands that we do not have any dealings with him and we totally disassociate ourselves from him. Furthermore, in the eyes of Shariah, a murtad is treated like a non-entity. When he is treated like a non-entity and we are strictly commanded to refrain from dealing with him then making a wasiyyat in his favour is not correct. However, if he is willing to understand Islam, one should invite him towards Islam. Once he embraces Islam, a wasiyyat can be made for him.
And Allah Ta'ala knows best.
